Finance Bill 2018

Finance Bill 2018 was published yesterday. The Finance Bill sets out in legislation the measures announced in the Budget and also additional proposed amendments to the Taxes Acts. See attached summary from the Irish Tax Institute with the main provisions of the Finance Bill. EU & UK technical notices on Brexit

UK Brexit Secretary Dominic Raab has today announced that the UK will publish a series of technical notices advising businesses and the public on what they need to do to prepare for a no deal Brexit. The notices will be issued over the coming weeks.

The EU has already produced 68 technical notices with advice on how countries, companies and individuals should prepare for the possibility of a no deal Brexit. The Preparedness Notices are available to review at www.ec.europa.eu. They cover a range of topics including customs and VAT proposals in the event of a no deal Brexit.

Dwelling House Relief

Finance Act 2017 brought some welcome changes to the Capital Acquisitions Tax Dwelling House Relief. Revenue have published an ebrief 023/18 outlining the detail of the changes. The changes confirm that there is no requirement for the house that is gifted to have been the PPR of the person making the gift. This will assist in cases where for example a parent has bought a house for an incapacitated child or where a child buys a house for her parents.

Recent Appeal Commissioners cases

There have been a number of recent Appeal Commissioners cases whereby the taxpayers have successfully challenged notices of assessment. In two cases the Appeal Commissioner has ruled that the spouse of the taxpayer is entitled to claim PAYE credit and lower rate tax band on state pension adult allowance payments. Revenue has indicated that they are appealing to the High Court but in the meantime you can make a protective claim for 2013-2016 so that in the event of the taxpayer being successful at the High Court your claim to relief is already registered with Revenue.
